1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition Excise Act, 2016.

3. Prosecution case is that 15 litres of illicit liquor was recovered in front of the house of the petitioner.

4. Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

5. Learned counsel for the State opposed the prayer for bail.

6. Considering the facts of the case, in the event of

Patna High Court CR. MISC. No.35539 of 2023(2) dt.21-07-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur in connection with Shahpur Police Station Case No. 187 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
