1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Charpokhari Police Station Case No. 50 of 2025, dated 19.02.2025, disclosing offences punishable under Sections 126(2)/115(2)/109/352/351(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 25 of the Arms Act.
3. The prosecution case, as per the First Information Report, is that on 19.02.2025, at about 3 PM, the petitioners along with other accused persons came at the door of the
Patna High Court CR. MISC. No.36151 of 2025(2) dt.18-06-2025 2/3 informant with lathi, danda etc., started abusing and when the informant objected, the accused persons assaulted him by lathi and danda and the petitioner no. 3, while fleeing, resorted to firing.
4. Learned Counsel for the petitioners submits that in the First Information Report, altogether eight persons have been made accused on the basis of general and omnibus allegation. The specific allegation of firing is upon petitioner no. 3, but nobody has sustained any fire arm injury and remnants of bullets have not been recovered from the place of occurrence. The petitioners are having no criminal antecedent. The occurrence has taken place due to dispute between the parties regarding drainage. The injuries caused to the informant are simple in nature, as would be evident from the injury report (Annexure 2).

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that there is dispute between the parties regarding drainage, the allegation against the petitioners are general and omnibus in nature, except the allegation of firing against petitioner no. 3, but nobody has sustained fire arm injury and the injuries caused to the informant are simple in
Patna High Court CR. MISC. No.36151 of 2025(2) dt.18-06-2025 3/3 nature, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur, at Ara, in connection with Charpokhari Police Station Case No. 50 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
