The petitioner apprehends his arrest in Paroo P.S. Case No.110 of 2019, corresponding to G.R. No.598/2019 registered under Sections 30, 30(a) of Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The recovery is said to have been made behind the house of the petitioner. The place from which the recovery was made is an open place.

Taking into consideration the fact that recovery from where the liquor was recovered is an open place situated behind the house of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within

No.33093 of 2019(2) dt.20-05-2019 2/2 a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Paroo P.S. Case No.110 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
