2. The accused/petitioner is named in the F.I.R. and apprehended his arrest in connection with Amarpur P.S. Case No. 515 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 74, 109(1), 303(2), 352, 351(2) and 3(5) of the BNS.
3. The allegation against the petitioner is to assault informant and others and also outrage the modesty of Bibi Akhtari and snatched her silver chain.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.33246 of 2025(2) dt.21-05-2025 2/3 petitioner submitted that present dispute arises out of local disputes and differences arising out of Nal Jal Yojana. It is further submitted that for the same set of occurrence a counter case was also lodged by petitioner, which has been registered as Amarpur P.S. Case No. 525 of 2024. It is submitted that occurrence was free fight, where both side received injuries. It is pointed that other co-accused persons namely Ansar Mansuri, Sabna Khatoon and Basir Mansuri were granted anticipatory bail by one of the learned Coordinate Bench of this Court through Cr. Misc. No. 83626 of 2024 vide order dated 11.12.2024. While concluding the argument learned counsel submitted that petitioner is a man of clean antecedent.
5. Learned APP appearing on behalf of the State, opposes the prayer for anticipatory bail.
6. In view of aforesaid facts and circumstances and by taking note of the fact as occurrence appears free fight in nature, where both parties received injuries, coupled with fact as petitioner is a man of clean antecedent and moreover, similarly situated co-accused persons have already granted

No.33246 of 2025(2) dt.21-05-2025 3/3 anticipatory bail as discussed aforesaid, accordingly the petitioner above named, in the event of his arrest or surrender before the learned Trial Court within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Banka/concerned Trial Court where the case is pending in connection with Amarpur P.S. Case No. 515 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS.
