The petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

The informant alleged that while he had gone to examination center after parking his motorcycle, his motorcycle was stolen. The informant came and lodged the case, but he came to know that a person was keeping a motorcycle in the stand and trying to commit theft of another motorcycle. It is submitted that no offence under Section 379 of the Indian Penal Code is made out. The petitioner did not commit theft of any motorcycle. The petitioner is mentally ill and he is in

Patna High Court Cr.Misc. No.26438 of 2015 (2) dt.24-07-2015 2/2 jail since 18.03.2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Motihari Town P.S. Case No. 181 of 2015.
