2. The petitioner has preferred this application for grant of regular bail in connection with Narayanpur P.S. Case No. 04/2025 dated 07.01.2025 registered for the offence punishable u/s 103(1) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, when the informant son was returning from the shop, the petitioner order to catch him and kill him. On hearing this, the co-accused persons caught hold of the informant's son and assaulted him with lathidanda, in the meantime, Gopal Yadav called on mobile and said to kill the informant's son. Thereafter, the co-accused Anil Kumar assaulted on the head of the informant's son with an iron rod causing head injury. Thereafter, the informant's son was taken to the hospital where the doctor declared him dead.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The specific allegation of assault is against the co-accused, Anil Kumar. Learned counsel has submitted that the petitioner is only an order giver. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.01.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Narayanpur P.S. Case No. 04/2025.
7. The application stands allowed.
