JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner seeks bail in a case for the offences punishable under sections 302 /34 of the I.P.C and section 27 of Arms Act.

The prosecution story, in brief, is that it is alleged that brother of the informant was living with Dharmendra Singh along with other friends and in the morning of 9.2.2014 Bhola informed that his son died due to injury on his forehead. On this information the informant rushed there and found his ATM Card and pass book are missing and the informant suspects the hand of Dharmendra and Mantu in the murder of his brother. On behalf of the petitioner it has been submitted that

Patna High Court Cr.Misc. No.26807 of 2015 (2) dt.28-07-2015 2/2 the petitioner is in custody since 11.3.2015. The petitioner is not named in the FIR. His name has appeared on the basis of confessional statement of a co-accused. Other co-accused have been granted bail by a Bench of this Court in Cr. Misc. no. 31953 of 2014.

On behalf of the State it has been submitted that the petitioner's name has been figured in course of investigation. In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Dehri, Rohtas in Dalmianagar P.S. Case No. 66 of 2014.
