JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Petitioner is languishing in custody since 27.02.2015 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The informant being robbed of Rs.
1,15,150/- the First Information Report was registered against unknown. The name of the petitioner sprang up on confession of the co-accused.
It is submitted by learned counsel for the petitioner that neither any recovery has been made from the petitioner nor the petitioner has been put on test identification parade. The statements to that effect have been made in para Nos. 6 and 7 of the petition.
Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.26260 of 2015 (2) dt.27-07-2015 2/2 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Navanagar P.S. Case No. 152 of 2014. Since the petitioner has criminal antecedent, learned Court below will be at liberty to cancel the bail bonds of the petitioner, if he gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
