The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and Section 307 has also been added during investigation.

It is a case of assaulting and snatching the golden chain of informant by the petitioner and co-accused persons.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case It is also submitted that there is no specific allegation of assaulting against the petitioner.

Patna High Court CR. MISC. No.35183 of 2022(2) dt.28-11-2022 2/2 Rather the allegation of assaulting with iron rod on head of the informant is against co-accused Nitish Kumar. There is no accusation of repeating the blow. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Baligaon P.S. Case No. 97 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
