JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 1006-2010 in a case registered under Sections-307/34 of the Indian Penal Code and 27 of the Arms Act. but uptill now, his trial could not be concluded though this court vide order dated 11-12-2013 passed in Cr. Misc. No. 43957 of 2013, strictly directed the trial court to conclude the trial of the petitioner within six months.

It would appear from impugned order that trial of the petitioner is pending for recording the evidence of one doctor.

Considering the period of detention of the

No.26400 of 2015 (2) dt.19-08-2015 2/2 petitioner in jail custody as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 25 of 2011 arising out of Maranchi P.S. Case No. 46 of 2009 to the satisfaction of Learned Additional Sessions Judge-III, Barh at Patna subject to condition that one of the sureties must be close relative of the petitioner and holder of landed property and the aforesaid surety shall file an affidavit before the court below stating therein as to how he is related with the petitioner.
