JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kundwa Chainpur P.S. Case No. 24 of 2019 registered for the offences punishable under Sections 272, 273, 420/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of huge quantity of liquor from the vehicle which was intercepted and driver disclosed the name of the petitioner. It further appears that petitioner is accused in two other case, one of which is of similar type.

Submission of learned counsel for the petitioner is that except disclosure made by co-accused there is nothing against him.

No.32526 of 2019(3) dt.29-07-2019 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioner has criminal antecedents and he is accused in four other cases, namely, Kundwa Chainpur P.S.Case No. 13 of 2017, Kundwa Chainpur P.S.Case No. 172 of 2018, Kundwa Chainpur P.S.Case No. 22 of 2018 and Kundwa Chainpur P.S.Case No. 24 of 2018. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. With the above observation, this application is dismissed.
