2. The petitioner seeks bail in connection with Samastipur Muffasil P.S. Case No. 125 of 2026 instituted for the offences under Sections 103(1), 238 & 61(2) of the Bharatiya Nyaya Sanhita.

3. The allegation is that the informant lodged information on 13.03.2026 that on 10.03.2026, 15 persons came to her house. The petitioner is named in the FIR. The informant further states that Vikesh Paswan and Akhilesh Kumar sat with her husband on the motorcycle. When the informant's husband did not came, then she started kept on enquiring. On 13.03.2026 at about 09.00 a.m., dead body of the informant's husband was

4. Perused the record.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Counsel submits that the petitioner is in custody since 15.03.2026, having no criminal antecedent. Counsel further submits that the case at best is of last seen. Moreover, there is a time lag of three days and thus, the gap between last seen and recovery of dead body loosens the connection between the last seen and death.

6. Learned A.P.P for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering that this is a case of last seen with time lag of 3 days, the petitioner has no criminal antecedent and he is in custody since 15.03.2026, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Samastipur, in connection with Samastipur Muffasil P.S. Case No. 125 of 2026.

9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
