JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-05-2019 The grievance of the petitioner in the present writ application is indecisiveness on the part of the Circle Officer, Rampur, Kaimur in Encroachment Case No.15 of 2017-18. Learned counsel for the petitioner submits that the Circle Officer, Rampur has initiated proceeding for removal of encroachment, but he is adopting dilly dally attitude in removal of encroachment.

Considering the aforesaid, the writ application is

Patna High Court CWJC No.10601 of 2019(2) dt.09-05-2019 2/2 disposed of with a direction to the Circle Officer, Rampur, Kaimur to take appropriate decision in the pending Encroachment Case No.15 of 2017-18 after hearing all stakeholders including the alleged encroachers and petitioner at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order. In the event, if he finds that there is encroachment over the public land, he shall take steps for removal of encroachment after recording the finding in encroachment proceeding.
