The petitioner is in custody since 08.02.2016 in connection with Chautham P.S. Case No. 15 of 2016 registered under Section 385, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Case Diary, in the present case, has been called for, which has since been received.

After hearing learned counsel appearing for the petitioner and the learned counsel for the State and on perusal of the F.I.R. as well as the material, which has surfaced in the case diary, it appears that the petitioner was the main assailant, who had fired from his country-made. It is also apparent from the

Patna High Court Cr.Misc. No.20135 of 2016 (3) dt.31-05-2016 injury report that there was injury to both the eyes caused by some explosive or fire arm injury. splinter was also found in both the eyes.

In view of the aforementioned facts and circumstances of the case, I am not inclined to grant regular bail to the petitioner. Hence, it is accordingly dismissed. (Anjana Mishra, J) brajesh/- U T
