This present application has been filed for transfer of Divorce Case No. 524 of 2019 from Principal Judge, Family Court, Bettiah to the Principal Judge, Family Court, Muzaffarpur.

It has been submitted by the learned counsel for the petitioner that the marriage of the petitioner was solemnized on 28.04.2016 as per Hindu rites. It is relevant to note that after marriage the opposite party started torturing the petitioner and used to threaten her for demand of dowry from her parents and even she was brutally assaulted by the opposite party. They

Patna High Court MJC No.1205 of 2020(3) dt.13-07-2022 2/2 tried to strangulate her by putting her dupatta around her neck but due to intervention of neighbours, anyhow she saved her life. It is also relevant to note that when she came to know about the divorce case filed by the opposite party, she along with her father went to Bettiha to contest the case, but she was threatened and forced to return to Muzaffarpur without attending the Court. Considering the difficulty being faced by the petitioner in travelling to Bettiha to contest her case, this application for transfer is allowed. Divorce Case No. 524 of 2019 pending in the Court of the Principal Judge, Family Court, Bettiah be transferred to the Court of Principal Judge, Family Court, Muzaffarpur. The parties shall appear in the Court of the Principal Judge, Family Court, Muzaffarpur and thereafter the proceeding will be conducted in the Court of the Principal Judge, Family Court, Muzaffarpur.

Let a copy of this judgment be communicated to the Principal Judge, Family Court, Bettiah as well as to the Principal Judge, Family Court, Muzaffarpur for its compliance. (Sandeep Kumar, J) Shishir/- U
