JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner seeks bail in a case for the offences punishable under sections 413, and 414/34 of the I.P.C The prosecution story, in brief, is that in course of investigation of Biraul P.S. Case No. 30/2015 and 88/2015 the police officials raided the house of one Nasim Ansari and on his confessional statement mobile was recovered and thereafter raided several other accused persons and in that course one Amir Ansari confessed his guilt and on his confession several articles were recovered and seized.

On behalf of the petitioner it has been submitted that

Patna High Court Cr.Misc. No.26806 of 2015 (2) dt.28-07-2015 2/2 the petitioner is in custody since 1.4.2015. Charge sheet has been submitted in the case. It is submitted that the petitioner has been made accused due to mistake of fact.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Biraul at Benipur, District- Darbhanga in Biraul P.S. Case No. 101 of 2015, G.R. No. 298/2015.
