The petitioners are languishing in custody since 02.06.2015 in connection with Govindganj P.S. Case No. 83 of 2014 for the offences instituted under Sections 341, 323, 302/34 of the IPC.
The prosecution story, in brief, is that the petitioners alongwith others brutally assaulted the nephew of the informant, namely, Chandan Kumar, leading to his death on the way to Motihari for treatment.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners are in
Patna High Court Cr.Misc. No.21188 of 2016 (3) dt.22-07-2016 2/2 custody since 22.07.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the evidence against the petitioners. General and omnibus allegation has been made against the petitioners. No specific injury is attributed against the petitioners. The other co-accused persons have been granted bail by this Court.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sadar, East Champaran, Motihari, in connection with Govindganj P.S. Case No. 83/2014.
