1. This application for impleadment as party respondent is being filed on behalf of intervener Shri Prabhat Ranjan Singh.

2. For the reasons mentioned in the Interlocutory Appplication, it is allowed and let the intervener be impleaded as party respondent in the present case.

3. Heard the learned counsel for the petitioner, learned counsel for the State and the learned counsel for the intervener.

4. From the impugned order and also from the argument of the learned counsel for the petitioner, it is clear that petitioner has not been heard though his show cause was filed.

5. The newly impleaded respondent has submitted that some wrong submission was made in this court before the interim order was passed in favour of the petitioner.

Without going into the disputed question of facts, this application is disposed of with liberty to the Circle Officer, Senari to hear all the concerned parties from the stage of notice and pass a fresh order in accordance with law in view of earlier order of this court passed in C.W.J.C. No. 6331 of 2017 which has been subsequently modified on 23.01.2019.

7. With the aforesaid observation and direction, this application is disposed of.
