Petitioner seeks bail in a case registered under sections 304B, 201/34 of the Indian Penal Code. Prosecution case, in short, is that the informant's sister was married with the petitioner in the year 2009. It is alleged that the accused persons demanded motorcycle and some money in dowry and due to non-fulfillment of demand they tortured and killed the victim.
On behalf of the petitioner it is submitted that petitioner has got no criminal antecedent and petitioner is in custody since 19.12.2014 cnd charge sheet in the case has already been submitted. It is submitted that the petitioner has been
Patna High Court Cr.Misc. No.27468 of 2015 (2) dt.31-07-2015 2/2 implicated in this case due to mistake of fact. On behalf of the State it is submitted that petitioner is named in the first information report and is the husband of the deceased.
Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. The same is rejected. Any how, the trial court is directed to expedite the trial and take all necessary steps to conclude the trial. (Sudhir Singh, J) M.Rahman/- U T
