JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioners are languishing in custody since 28.4.2015 in connection with Nautan P.S. Case No.113 of 2015 for the offence instituted under Section 364(A) of the I.P.C. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that there is allegation that though marriage of the victim was fixed to be solemnized on 30.4.2015 but the daughter of the informant became traceless. It has been submitted on behalf of the petitioners that the petitioner is in custody since 28.4.2015and the charge sheet has been submitted in the present case. There is no criminal antecedent against these petitioners. Even the victim in her 164 Cr.P.C.
Patna High Court Cr.Misc. No.26643 of 2015 (3) dt.12-08-2015 2/2 statement has not named these petitioners.
On behalf of the State it has been submitted that the petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Nautan P.S. Case No.113 of 2015.
