JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This is an application for grant of anticipatory bail in connection with Gurua P.S. Case No. 158 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 337, 448, 307, 379, 504, 506 & 302 of I.P.C.

Allegation against the petitioners and other accused persons is that they came to the place of occurrence where the informant was constructing rig, they damaged the rig and also assaulted the informant and other family members as well as brother of the informant. Later on brother of informant died. Submission of learned counsel for the petitioners is that brother of the informant died after one month of the occurrence due to some ailment, furthermore, injury report of the informant states that he had sustained simple injury and no specific allegation has been attributed against any of the

The similarly situated co-accused have already been granted anticipatory bail by different coordinate Benches of this court as well as by this court vide Criminal Misc. No. 31693 of 2019, Criminal Misc. No. 30578 of 2019 and Criminal Misc. No. 32390 of 2019.

Having heard both sides, in view of the facts that especially the other co-accused persons have been granted anticipatory bail and case of the petitioners are also similar in nature.

Let the petitioners no. 1, 2 and 3 above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M, Gaya in connection with Gurua P.S. Case No. 158 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
