2. The petitioner seeks bail, who is in custody since 20.01.2026 in connection with Banka P.S. Case No. 586 of 2025, F.I.R. dated 24.12.2025 registered for the offence punishable under Sections 75/76/64/62 of BNS and Section 8 of POSCO Act.
3. Allegation against the petitioner is that he grabbed the informant's minor daughter from behind and tried to do wrong with her.
4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. The allegation
Patna High Court CR. MISC. No.39865 of 2026(2) dt.23-06-2026 2/2 as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.
5. Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that the allegation against the petitioner is that he has tried to do wrong with the victim and victim girl is minor and she is mentally challenged.
6. Considering the nature of allegation in the FIR supported by the medical evidence as well as statement of the victim which was recorded under Section 183 of BNSS, 2023 and date of birth of the victim is 05.02.2009 which suggests that on the date of occurrence, the victim was minor, I am not inclined to enlarge the petitioner on bail in connection with Banka P.S. Case No. 586 of 2025 pending in the court of learned Additional District and Sessions Judge-VI-cum-Special Judge (POCSO) Banka.
