The petitioners seek bail in a case under Section 395, 397 of the Indian Penal Code and under section 27 of the Arms Act.

The petitioners are not named in the FIR. Nothing has been recovered from the possession of the petitioners. The names of petitioners firstly figured in the confessional statement of co-accused Jagarnath Sah @ Mishri Jee. The petitioners are also said to have confessed their guilt but except the confession the police did not collect any further evidence. The petitioners are in jail since 16.01.2015 but they have not been put on T. I. parade

Patna High Court Cr.Misc. No.30779 of 2015 (2) dt.14-08-2015 2/2 and other similarly situated accused have already been enlarged on bail.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional, Judicial Magistrate, Raxaul at Motihari, East Champaran in Chhauradano P.S. Case No. 8/2015.
