Petitioner seeks bail in a case registered under sections 489B, 489C/34 of the Indian Penal Code as well as sections 16, 17 of the Unlawful Activity Act.

Petitioner was neither caught on the spot nor anything was recovered from his conscious possession.

However, it appears from perusal of the first information report that apprehended co- accused disclosed that seized amount had to be delivered to the petitioner. The impugned order shows that charge sheet has already been submitted but it is not clear from the impugned order as to whether any incriminating material was recovered from possession of petitioner or not after the above stated disclosure of co- accused.

Patna High Court Cr.Misc. No.20480 of 2016 (2) dt.13-05-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in A.T.S.P.S. Case no. 01/2015.
