The petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code and under Section 27 of the Arms Act. The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of coaccused. The petitioner is also said to have confessed his guilt, but nothing has been recovered from his possession. The petitioner is not put on test identification parade although he is in custody since 16.01.2015. Other accused persons have already been enlarged on bail.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.28318 of 2015 (2) dt.05-08-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in Chhauradano P.S. Case No. 8 of 2015.
