The petitioner seeks bail in connection with Chanpatia (Kumarbag O.P.) P. S. Case No.515 of 2020, instituted for the offences under Sections 341, 323, 307, 337, 354(B), 447 and 504/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation as alleged in the F.I.R. is of pulling the cloth of the mother of the informant and also assaulted by coaccused Dhananjay Kumar and Bhukhal Kumar. Dhananjay Kumar, who assaulted the informant on his head and when the

The learned counsel for the petitioner submits that admittedly, the dispute was with respect to a passage and though it is alleged that this petitioner is not alleged to have assaulted either the informant and his father and the injury is also simple in nature. The allegation against him is only that he tried to pull the cloth of mother of the informant in an intoxicated condition. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 15.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Chanpatia (Kumarbag O.P.) P. S. Case No.515 of 2020. The application stands allowed.
