The petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 120B of the Indian Penal Code later on Section 365 of the Indian Penal Code was added.

The informant alleged that Rabindra Yadav dragged his brother Buchi Yadav and thereafter Manish Yadav, Uday Yadav and Subodh Yadav kidnapped Buchi Yadav on a Sumo Victa vehicle.

It is submitted that the name of the petitioner figured in the case in the slip give by Manish Yadav on which the mobile number of the petitioner was written and the accused disclosed that the petitioner got the land of the victim transferred in his

Patna High Court Cr.Misc. No.38712 of 2015 (2) dt.27-08-2015 2/2 name. The victim returned on the same day. Similarly situated coaccused Manish Yadav, Subodh Yadav and Uday Yadav have already been enlarged on bail vide orders passed in Cr. Misc. No. 19333 of 2013.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Ranjan Raman, the learned Judicial Magistrate, Ist Class, Bhagalpur in Lodipur P.S. Case No. 07 of 2013.
