JUSTICE SUDHIR SINGH ORAL ORDER 18-07-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.

The petitioner is languishing in custody since 09.03.2016 in connection with Sangrampur P.S. Case No. 79 of 2015 for the offences instituted under Section 341, 323, 304(B)/34 of the IPC and 3⁄4 of the D.P. Act.

The accusation is of killing the daughter of the informant for non-fulfilment of dowry demand by the accused persons. It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 09.03.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. It is said to be accidental death as the deceased had fallen from the terrace and sustained injury.

No.20185 of 2016 (3) dt.18-07-2016 2/2 On behalf of the learned counsels for the informant and the State it has been submitted that the petitioner is named in the F.I.R. and he is the husband of the deceased. The postmortem report discloses the injury on the head is caused by sharp cutting weapon.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Sangrampur P.S. Case No. 79/2015, pending in the court of the learned C.J.M., Munger. Anyhow, the trial court is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of copy of this order.
