The petitioners are languishing in custody since 21.03.2015 in a case registered for the offences punishable under Sections 341, 323, 504 and 366A/34 of the Indian Penal Code.

The prosecution case is that on 09.03.2015 Chhabi Kumar, the son of petitioner no. 1, kidnapped the daughter of the informant Kalo Kumari. It is also alleged that when the informant went to the house of the petitioners to make enquire then Chhabi Kumari and the petitioners being the father and

Patna High Court Cr.Misc. No.27154 of 2015 (2) dt.31-07-2015 2/2 brother of Chhabi Kumar assaulted the informant. It is submitted by learned counsel for the petitioners that Chhabi Kumar married with the victim girl and they are residing together and Chhabi Kumar is also traceless since the institution of the case.

Considering the thrust of accusation against Chhabi Kumar and the investigation has already concluded, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 23 of 2015.
