JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 147, 148, 149,341, 323, 333, 353, 307 of the Indian Penal Code and 27 of Arms Act.

Accusation is that the informant being the Officer Incharge of Hemjapur Out Post on receiving information on 13.03.2016 at about 9 A.M. about loot of Masoor crops of Baleshwar Yadav by notorious criminals, namely, Pintu Yadav, Ranbir Kumar Yadav, Rupesh Yadav,Guljabi Yadav and Ram Balak Yadav and Baleshwar Yadav has been confined by them, reached there and on seeing police party they started fleeing away on horse towards west, who were chased and then they started firing. Learned counsel appearing on behalf of the petitioner submits that, in fact, from perusal of FIR, it would appear that no incriminating article has been recovered from the possession of the petitioner. The petitioner has been falsely implicated in the present case at the instance of Baleshwar Yadav with whom the petitioner has land dispute and also lodged Dharahara P.S.Case No. 34 of 2016 under Section 395 IPC on the same day regarding same occurrence at about 7 A.M in which the petitioner is on bail. Further submission is that the petitioner having no criminal antecedent is in custody since 22.3.2016. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Dharahara P.S.Case No. 35 of 2016.
