JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2019 This is an application for grant of anticipatory bail in connection with Gwalpara P.S. Case No. 92 of 2018, disclosing offences under Sections 406, 409, 420 and 120B of IPC. Allegation as per F.I.R. is of defalcation and misappropriation of crores of rupees by one co-accused Sambhu Kumar Rajak, Postal Peon/server of Gwalpara Sub Post Office. It is further alleged that he got opened several accounts in the name of his relatives and friends and transferred the amount in their account and thereafter, withdrawing the same. It is also alleged that in the account of petitioner also defalcated amount was transferred and same was withdrawn by some other persons.
Submission of the learned counsel for the petitioner is that he has no hand with said Shambu Kumar Rajak, who has

Considering the same, other co-accused have already been granted bail by different Coordinate Benches of this Court, vide order dated 23.01.2019 passed in Criminal Misc. No. 1610 of 2019 and vide order dated 17.04.2019 passed in Criminal Misc. No. 6747 of 2019. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Shri Shiv Kumar learned Judicial Magistrate, 1st Class, Udakishunjganj, Madhepura, in connection with Gwalpara P.S. Case No. 92 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
