JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-08-2023 The petitioner in the present case is seeking a direction to the respondent authorities to accept the registration form of the student of petitioner college with additional delay fine for B.A./B.Sc. Part-I (Hons.) Course of Session 2017-18. The petitioner claimed that it is a college affiliated by the Magadh University and was established in the year 1987. Initially, it was given temporary affiliation which was extended from time to time.
2. A counter affidavit has been filed on behalf of the Magadh University. It is stated that the Principal and the Secretary of the Governing Body of the college had fraudulently managed to provide a fake and forged letter dated 12.05.2013 of the State
Patna High Court CWJC No.10568 of 2019(6) dt.16-08-2023 2/2 Government by which it was shown that the State Government had granted permanent affiliation to the College for Arts and Science Faculty to Honours level from Academic Session 2012-13.
3. The counter affidavit has narrated in detail about the verification process. It is categorically stated that the State Government in response to the University Letter dated 06.04.2019 informed the University that the letters purpotedly shown to have been issued by the State Government are fake, forged and fabricated letters and accordingly, Magadh University was directed to lodge FIR against the concerned employee of the University. It is specifically stated that the College of the petitioner has not been granted affiliation by the State Government till date.
4. Having regard to the kind of disputes involved in this writ application, this Court finds no reason to proceed with this.
5. Learned counsel for the petitioner agrees at this stage that this writ application seems to have become infructuous.
6. In the aforesaid view of the matter, it is being disposed of as having become infructuous.
