JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-08-2021 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. Learned counsel for the petitioners undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioners seek bail in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
Vide order dated 07.04.2021, the bail application of the petitioners was rejected in Cr. Misc. No. 38029 of 2020 with liberty to renew their prayer for bail after surrendering the
Patna High Court CR. MISC. No.44473 of 2021(2) dt.18-08-2021 2/2 husband of the deceased before the learned court below. Learned counsel for the petitioners submits that on 02.06.2021, the husband of the deceased Md. Kayim has surrendered before the learned court below.
Considering the facts and circumstances of the case and the fact that the husband of the deceased has surrendered before the learned court below, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Narpatganj P.S. Case No. 161 of 2020.
