JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 397 of the Indian Penal Code.
Petitioner was arrested on the basis of confessional statement of co-accused and some cash, dagger and Penchkash are said to have been recovered from conscious possession of the petitioner.
It appears that no stolen article has been recovered from conscious possession of the petitioner and except the aforesaid facts and criminal antecedent of the petitioner, there appears to be nothing against him.
Accordingly, petitioner named above, is directed to be
Patna High Court Cr.Misc. No.20389 of 2016 (2) dt.13-05-2016 2/2 released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sugauli(G.R.P.) Rail P.S. Case No. 37 of 2015 to the satisfaction of learned Railway Judicial Magistrate, Bettiah, West Champaran.
