23-01-2015 Heard learned counsel for the petitioner and learned AC to SC-9.

The petitioner, who is admittedly second wife of the deceased employee, who died on 02.09.2007 as constable from the District Police, Bhagalpur, has prayed for directing the Respondents/State to allow payment amount of Provident Fund, Pension, L.I.C. and other benefits, which was granted earlier to Respondent no.6, who was the first wife of deceased employee. It has been accepted that Respondent no.6 is getting all retiral dues. Keeping in view the fact that the petitioner is the

Patna High Court CWJC No.3146 of 2014 (3) dt.23-01-2015 2/2 second wife of the deceased employee and she has claimed her share in the retiral dues of deceased employee, the Court is of the opinion that such dispute may not be adjudicated, while exercising writ jurisdiction.

The writ petition stands dismissed.
