Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has preferred this application for grant of regular bail in connection with Sangrampur P.S. Case No. 271 of 2021 dated 10.12.2021 registered for the offences punishable u/s 341, 323, 324, 307, 504, 506, 498A/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act. As per the prosecution case, the petitioner and the other two accused persons came to the informant's house and started using filthy language, when the informant objected it,

No.38992 of 2023(2) dt.28-06-2023 2/3 accused persons said that why the informant did not give the buffalo, cash of Rs.1,00,000/-, golden chain and other articles which was agreed for the dowry. Thereafter, the accused persons broke the door and entered the house and poured petrol over the daughter and mother of the informant and set them ablaze by throwing ignited match stick and fled away on a four-wheeler. Thereafter, the injured daughter and mother of the informant was taken to the hospital for treatment.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner neither demanded dowry nor tortured the daughter of the informant. The co-accused person has already been granted bail by the Coordinate Bench of this Court vide order dated 24.2.2023 passed in Cr. Misc. No. 61901 of 2022. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.12.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.38992 of 2023(2) dt.28-06-2023 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 271 of 2021.

The application stands allowed.
