JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 13.04.2013 in a case registered for the offences punishable under Section 379 and 411 of the Indian Penal Code.

The accusation is of committing theft of belongings of the informant while travelling in the train. Subsequently, theft mobile was alleged to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that IMI number of the recovered mobile does not tally with the stolen mobile which gets reflected from the FIR as well as seizure list. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, the investigation has already concluded.
