In this case, the petitioner is seeking bail in connection with Shikarpur P.S. Case No. 457 of 2015 registered for offences under sections 363, 366(A) of the Indian Penal Code and later on, section 376 of the Indian Penal Code and section 4 of the POCSO Act were added.

Allegation has been made that the petitioner allured the victim girl, took her and also subjected her to the sexual assault which the victim has narrated in her statement recorded under section 164 of the Criminal Procedure Code. The counsel for the petitioner submits that the petitioner and the girl were recovered at the railway station while

Patna High Court Cr.Misc. No.21164 of 2016 (2) dt.19-05-2016 2/2 both were sitting, but during investigation it has come that the petitioner has adopted modus operandi for alluring the girl, took her and committed sexual assault. The age of victim is aged 14 years old.

In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition is rejected. However, liberty is given to the petitioner, he may renew his prayer for bail after one year of custody.
