JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and section 25(1-b)a, 26,35 of the Arms Act.

As per allegation in the F.I.R, two accused persons were caught by the police and from possession of co-accused Dhananjay Kumar, one country made pistol and mobile was recovered and one country made pistol and motorcycle was recovered from possession of co-accused Rahul Kumar. They disclosed that country made pistol was given to them by Chandan Ram.

Learned counsel for the petitioner submits that the name of petitioner has transpired on the basis of confession

Patna High Court CR. MISC. No.44433 of 2021(2) dt.23-03-2022 2/2 statement of co-accused persons. Nothing incriminating article has been recovered from possession of the petitioner. Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioners, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 4th, Bettiah in connection with Balthar P.S.Case No. 07 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.s (Sunil Kumar Panwar, J) N.K/- U
