JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b) 26 of the Arms Act and 37(b) (c) Bihar Madhya Nisedh and Excise Amendment Act 2018.

One country made loaded pistol is said to have been recovered from conscious possession of the petitioner and when the petitioner was arrested, he was found in drunken condition. Petitioner does not have any criminal antecedent and is languishing in jail custody since 13.02.2019. Submission on behalf of the petitioner is that there was some land dispute between the petitioner and his uncle and

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, ,Patna in connection with Special Case No. 1639 of 2019 arising out o f Danapur P.S. Case No. 125 of 2019.
