The petitioner is in custody in a case registered under Sections 363 and 366A of the Indian Penal Code. The prosecution case, in brief, is that on 26.3.2015 at about 8.10 P.M. in the night while informant's daughter, namely, Puja Kumari, aged about 14 years, had gone to a nearby shop to bring some articles, then some unknown persons had kidnapped her forcibly by carrying her in a Scorpio and further alleged that when the daughter of the informant did not return, then the informant and his family members made frantic search to trace her out but she could not be traced out. It has further been alleged that prior to the said occurrence, his

No.26522 of 2015 (2) dt.27-07-2015 2/2 daughter used to talk on informant's mobile to mobile No.9525383380 and the informant has got suspicion that the consumer of said mobile number has kidnapped his minor daughter by inducing her in order to marry her. On behalf of the petitioner, it is submitted that the petitioner is in custody since 1.4.2015 and charge sheet has been submitted in the case. The petitioner has no criminal antecedents. From perusal of the statement made by the victim under Section 164 Cr.P.C., it is evident that the victim has married with petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No.176 of 2015.
