The petitioner seeks bail in a case for the offences punishable under sections 147, 148, 149, 341, 323, 337, 338, 307, 120 (B) and 302 of the I.P.C The prosecution story, in brief, is that on receiving information that her husband lying on road with blood and police personnel surrounded him she reached there and suspicion has been raised that due to rivalry regarding Bus agent under conspiracy her husband was done to death.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 17.4.2015. It is further alleged that at the time of date of occurrence the petitioner was in custody
Patna High Court Cr.Misc. No.26819 of 2015 (2) dt.28-07-2015 2/2 and only on suspicion he has been involved in this case as there was previous enmity prevailing between the parties in respect of settlement of Bus stand. There is no circumstantial evidence to suggest implication of the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Darbhanga in Laheriasarai P.S. Case No. 148 of 2015.
