JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 19.3.2015 in Maheshkhut P.S. Case No.36 of 2015 for the offence under Sections 399, 400, 412/34 of the I.P.C. and 25(1-B) A 26/35 of Arms Act.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on receipt of the telephonic information that some miscreants were fleeing away after committing dacoity he along with police personnel started checking vehicles in course of which one motor cycle coming towards Choutham suddenly stopped and two persons started fleeing away but on chase they were apprehended. The petitioner including two co-accused persons were also

Patna High Court Cr.Misc. No.26752 of 2015 (2) dt.29-07-2015 2/2 apprehended by the villagers.

On behalf of the petitioner it has been submitted that he is in custody since 19.3.2015 and charge sheet has already been submitted. He has no criminal antecedent. So far as the petitioner is concerned no firearm has been recovered from his possession. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria, in Maheshkhut P.S.Case No.36/15.
