JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 379 and 411 of the Indian Penal Code. Submission of learned counsel appearing on behalf of the petitioner is that the petitioner is not named in the FIR. In course of investigation stolen motor cycle is said to be recovered from the possession of the petitioner but the seizure list would indicate that on 10.11.2015 stolen motor cycle was recovered by the police near Oil Depot Durga Mandap Sant Kabir Road,Banuchapar and not from the possession of the petitioner. In fact, the petitioner is accused in three other cases in which he is on bail and due to that reason the petitioner has falsely been

Patna High Court Cr.Misc. No.19320 of 2016 (2) dt.06-05-2016 2/2 implicated in the present case. The petitioner is in custody since 11.12.2015.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., West Champaran at Bettiah in connection with Bettiah (Manuapul) P.S.Case No. 650 of 2015.
