1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the informant and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 304 and 120(B) of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 18.03.2024 and is a woman and the informant alleges that his wife was pregnant and the expected date of delivery was 12.08.2023, but labour pain started on 07.08.2023, hence he was taking his wife to the hospital,
Patna High Court CR. MISC. No.40434 of 2024(2) dt.21-09-2024 2/3 but then, he met the petitioner, who happens to be a Asha Worker and on her advise, his wife was taken to Maa Kripa Emergency Hospital where both the child and the mother died.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is also submitted that even presuming what has been alleged is true without admitting, then the only allegation against this petitioner is that on her advise, the petitioner took his wife to Maa Kripa Emergency Hospital where both the mother and child died. It is next submitted that petitioner in no manner was associated with the operation of the wife of the informant for delivering the child. It is further submitted that charge-sheet has been submitted and petitioner will not abscond rather will cooperate in the trial to prove her innocence.
5. Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the bail application.
6. Considering the submissions made by the

No.40434 of 2024(2) dt.21-09-2024 3/3 petitioner, the petitioner, above-named, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IV, Bhojpur at Ara in connection with Piro P. S. Case No.365 of 2023.
7. The application stands allowed.
