JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-08-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Pauthu P.S. Case No. 71 of 2021, registered for the offences punishable under Sections 147/149/341/323/325/307/504/506 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is case and counter case and the members of the defense side have also been injured.

There is allegation against the petitioners that they assaulted on the head of Anant Kumar and he suffered three injuries.

Patna High Court CR. MISC. No.35446 of 2022(2) dt.26-08-2022 2/2 Injury no. 1 is on head and it is grievous in nature. Considering the above mentioned facts and circumstances, the petitioners do not deserve the privileges of anticipatory bail. Accordingly, it is rejected.

The petitioners are directed to surrender before the court below and make a prayer for regular bail.

As submitted, father of the petitioners has died on 18.08.2022, and they have to participate in last rites of their father. So far as, father of the petitioners has died and being sons they have to participate in the last rites. They are directed to surrender after ten days from today. Within these ten days no coercive steps shall be taken against the petitioners. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
