JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 09-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant The petitioner seeks bail in connection with Begusarai Muffasil (Lakho) P.S. Case No.110 of 2016 registered under Sections 147, 148, 149, 341, 323, 307, 427, 385, 387, 504 and 506 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that NBHC Company, who used to provide accommodation for storage, of which the informant was an employee, took the godown of the father of the petitioner on rent in which maize was restored. On 16.03.2016, when the uplifting of maize from the godown was started, at that time, this petitioner, his family members, named in the F.I.R, and 23-30 unknown persons started to pelting stone and made indiscriminate firing about 12-15 rounds.

Patna High Court Cr.Misc. No.19548 of 2016 (2) dt.09-05-2016 2/2 Earlier, the petitioner and the co-accused Subodh Singh had demanded Rangdari of Rs.50,00,000/- regarding which Begusarai (Town) P.S. Case No.93 of 2016 was instituted by the Company, due to that reason, threatening was given of dire consequences.

Learned counsel appearing on behalf of the petitioner submits that, in fact, there was dispute between the father of the petitioner and the Company about the tenancy and due to that reason, the present false case has been lodged. Moreover, the petitioner is in custody since 16.03.2016 and the chargesheet has already been submitted in the case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Muffasil (Lakho) P.S. Case No.110 of 2016.
