2. The petitioner seeks regular bail in connection with Supaul Police Station Case No. 623 of 2022, registered for the offence punishable under Section 25(1-B)A/26/35 of the Arms Act.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired on the basis of confessional statement of co-accused namely Wakil Sah @ Wakil Kumar and Santosh Kumar Yadav. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 07.02.2023.
4. Learned APP has vehemently opposed the prayer
Patna High Court CR. MISC. No.35385 of 2023(2) dt.12-07-2023 2/2 for bail.
5. Considering the period of custody, this application is allowed.
6. Let the petitioner, above named, be released on bail after completing nine months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Supaul Police Station Case No. 623 of 2022.
7. This is also subject to the conditions that the petitioner shall mark his presence in Supaul Police Station, District- Supaul on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. (Sandeep Kumar, J) Ranjeet/- U T
