The petitioner seeks bail in connection with Ramnagar P.S.Case No. 36/2014 for the offences punishable under sections 461 and 379 of the Indian Penal Code.

The prosecution case, in brief, is that one Sanjay Kumar gave a written report that from his Mobile Care shop in front of Gandak Colony, P.S. Ramnagar, 30-40 mobiles were taken away, and accordingly Ramnagar P.S. Case No. 270/14 dated 6-12-14 was lodged for the offences punishable under sections 461 and

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. It has been further submitted that no T.I. Parade has been conducted till date. Further, it has been submitted that there is no recovery of any incriminating article from the possession of the petitioner. The petitioner is in jail since 12-11-2014. It has been stated on behalf of the State that the petitioner's name has come in course of investigation.

Considering the facts and circumstances of the case, let the petitioner Arman Dewan be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Bagaha, West Champaran in Ramnagar P.S. Case No. 270/2014.
