JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.
Allegation against the petitioner is that he snatched Rs.3 lacs from the informant which he had withdrawn from bank. It has been submitted on behalf of the petitioner that he is in custody since 19.1.2016. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. No looted article is said to have been recovered from the possession of the petitioner. Petitioner has not been put on T.I.P. to ascertain his involvement for committing an offence under Section 392 of the Indian Penal Code. At best, an offence under the Arms Act is only made out as one loaded pistol with four cartridges are said to have been recovered. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.20985 of 2016 (4) dt.21-07-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case no. 35 of 2016.
